DATA PROTECTION

If you are our customer, a prospective customer of our services or a visitor to our website, you are entrusting us with your personal data. We are responsible for their protection and security. Please familiarise yourself with the data protection, policies and rights you have in relation to the GDPR (General Data Protection Regulation).

I. Who is the Data Controller

The administrator of personal data on the website www.chudadlo.cz is Vít Procházka, Plavsko 27, 378 02 Stráž nad Nežárkou, ID 73481874, VAT: CZ 8204101400. E-mail: vitek@chudadlo.cz. I process your personal data as a controller, i.e. I determine how the personal data will be processed and for what purpose, for how long and I select any other processors who will assist me with the processing.

III. I declare

I declare that as the controller of your personal data, I comply with all legal obligations required by applicable legislation, in particular the Data Protection Act and the GDPR, and therefore that:

I will only process your personal data on the basis of a valid legal ground, in particular a legitimate interest, the performance of a contract, a legal obligation or consent. I comply with the information obligation under Article 13 of the GDPR before processing personal data. I will enable and support you in exercising and fulfilling your rights under the Data Protection Act and the GDPR.

IV. Scope of personal data and purposes of processing

I process the personal data you entrust to me for the following reasons (to fulfil these purposes):

Provision of services, performance of contract

Your personal data in the following scope: e-mail, name, surname, home address, in the case of purchase as an entrepreneur or company, also ID number and VAT number, account number, or telephone number are necessary for the performance of the contract (e.g. sending access to the application, sending online course, delivery of goods, etc.).

Bookkeeping

If you are a customer, I necessarily need your personal data (billing data) to comply with the legal obligation to issue and record tax documents.

Marketing – sending newsletters

I use your personal data (email and name), gender, what you click on in the email and when you open it most often for direct marketing purposes – sending you commercial communications. If you are a customer of mine, I do so out of legitimate interest, as I reasonably assume that you are interested in our news.

You can unsubscribe from receiving newsletters by email.

Photographic documentation, references

Only with your consent may I use your photographs, videos or written testimonials on my site until you withdraw your consent. This can be revoked at any time via our contact details.

I will retain your personal data for the duration of the limitation periods, unless the law provides for a longer period of time to retain it or we have specified otherwise in specific cases.

V. Cookies

When you browse my website, I record your IP address, how long you stay on the site and which page you come from. I see the use of cookies to measure website traffic and to personalise the display of the website as a legitimate interest of the administrator, as I believe that this enables me to offer you an even better service.

VI. Security and protection of personal data

I protect personal data to the maximum extent possible by using modern technologies that correspond to the state of the art. I protect it as if it were my own. I have adopted and maintain all possible (currently known) technical and organisational measures to prevent the misuse, damage or destruction of your personal data, in particular:

Secure access to my computer (password protected).

Secure access to my phone (password protected).

Secure access to my email inboxes (secured by username and password).

Secure access to email distribution applications (secured by name and password).

Secure access to billing systems (secured by name and password).

Secure access to the member sections of the site (secured by username and password).

By regularly updating the software.

Personal data will be processed in electronic form in an automated manner or in paper form in a non-automated manner.

VII. Transfer of personal data to third parties

My employees and associates have access to your personal data.

To ensure specific processing operations that I cannot provide on my own, I use the services and applications of processors who can protect data even better than I can and specialise in the processing.

I may only disclose the personal data that I process as a controller and as a processor to collaborators and processors who provide administrative and technical support for the operation of applications

necessary for the operation of the website and supporting applications or are involved in the operation of my business (accountants).

Other entities are allowed access only for the purpose of fulfilling their legal obligations.

I assure you that my collaborators who will process your personal data are obliged to maintain confidentiality of personal data and security measures, the disclosure of which would compromise the security of your personal data.

This confidentiality continues even after the end of the contractual relationship with me. Your personal data will not be released to any other third party without your consent.

I will not transfer your data to third countries. I only process data in the European Union or in countries that provide an adequate level of protection based on a decision of the European Commission.

VIII. Your rights in relation to the protection of personal data

You have the right to information, which is already fulfilled by this information page with the personal data processing policy.

Thanks to the right of access, you can challenge me at any time and I will provide you with evidence within 5 days of what personal data I am processing and why.

If something changes or you find your personal data outdated or incomplete, you have the right to have your personal data completed and amended.

You can exercise your right to restriction of processing if you believe that I am processing your data inaccurately, if you believe that I am processing unlawfully but you do not want to delete all the data or if you have objected to the processing. You can limit the scope of personal data or the purposes of processing. (For example, by unsubscribing from the newsletter you limit the purpose of processing for sending commercial communications.)

Right to erasure (to be forgotten): another right is the right to erasure (to be forgotten). I don’t want to forget you, but if you wish, you have the right to do so. In this case, I will delete all your personal data from my system and the system of all sub-processors and backups. I need 10 days to secure the right to erasure.

In some cases, I am bound by a legal obligation and, for example, I have to keep records of tax documents issued for the period prescribed by law. In this case, I delete all such personal data that are not bound by another law. I will inform you by e-mail when the deletion is completed.

Complaining to the Data Protection Authority If you feel that I have not handled your data in accordance with the law, you have the right to complain to the Data Protection Authority at any time. I will be happy if you first inform me of this suspicion so that I can do something about it and correct any wrongdoing.

Unsubscribe from newsletters and commercial communications Emails with inspiration, articles or products and services are sent to you if you are my customer based on my legitimate interest.

You can stop receiving my emails at any time by sending me an email.

IX. Confidential

I would like to assure you that my employees and associates who will process your personal data are obliged to maintain confidentiality of personal data and security measures, the disclosure of which would compromise the security of your personal data. This confidentiality shall continue even after the termination of the contractual relationship with us. Your personal data will not be released to any other third party without your consent.

Previous Privacy Policy

Personal data protection is provided by Act No. 101/2000 Coll., on the Protection of Personal Data, as amended.

Which personal data I collect:

When visiting the chudadlo.cz website, you agree to the processing of the following personal data: name and surname, home address, identification number, tax identification number, e-mail address, telephone number and bank account (hereinafter collectively referred to as „personal data“). You agree to the processing of personal data by me as the seller for the purpose of exercising the rights and obligations under the purchase contract and for the purpose of sending information and commercial communications to me as the seller.

When you visit my website, our web servers will record in a standard way the IP address assigned to you by your Internet service provider, the website from which you visit my website, the websites you visit with me, and the date and length of your visit. Personal data will only be recorded if you provide it to me of your own free will, for example, as part of registration, surveys, prize draws or to fulfil a contract.

Warranty:

I will never pass on your personal data to third parties without your prior consent. I take technical, organisational and security measures to protect the data held by me against manipulation, loss, destruction and interference by unauthorised persons.

Processing time:

Personal data will be processed for an indefinite period of time. Personal data will be processed in electronic form in an automated manner or in paper form in a non-automated manner.

Voluntariness and cancellation:

You confirm that the personal data you have provided is accurate and that you are aware that this is a voluntary provision of personal data. You declare that you have been informed that you may withdraw your consent to the processing of personal data in relation to me as the seller by written notice delivered to my address.

Resolution in the event of a breach:

Should you believe that the processing of your personal data is being carried out in violation of your protection of your private and personal life or in violation of the law, in particular if the personal data is inaccurate with regard to the purpose of its processing, you may ask me for an explanation and request that I remedy the situation. In particular, this may involve blocking, correcting, supplementing or destroying the personal data. If your request pursuant to the previous sentence is found to be justified, I will immediately rectify the defective situation. If I do not comply with your request, you have the right to contact the Data Protection Authority directly. This provision is without prejudice to your right to address your complaint directly to the Data Protection Authority.

Right to information:

If you ask me for information about the processing of your personal data, I am obliged to provide you with this information. I have the right to request a reasonable fee for providing the information referred to in the preceding sentence, not exceeding the costs necessary to provide the information.

Which you agree with:

You agree to receive information regarding my work and services at your email address. You agree to the inclusion of all your personal data in the database of the natural person entrepreneur Vít Procházka, Plavsko 27, 378 02 Stráž nad Nežárkou, ID 73481874, VAT: CZ 8204101400. E-mail: vitek@chudadlo.cz, as the controller, and with their subsequent processing by the processor for marketing purposes and commercial communications by electronic means in accordance with Act No. 480/2004 Coll., for the period until the withdrawal of consent. You consent to my sending you information about upcoming events and offers from my business partners.

Cookies:

Cookies are small „files“ that are stored on your hard drive. This leads to easier navigation and a high level of user experience on the website. Cookies can be used to determine whether you have already visited our site from your computer. Only the cookie on your computer is identified. You can deactivate the use of cookies in your internet browser.
